Bullying and Harassment (SP 6.110)

The administration of the Metropolitan Nashville Public Schools is committed to providing all students a learning environment free from bullying or harassment based on race, color, religion, national origin, handicap/disability, sexual orientation, ancestry, or gender including gender identity, expression and appearance.

National Policies

Students, teachers, administrators, and other school personnel are protected by a number of federal policies. Please see resources below to familiarize yourself with current or pending federal policies that support inclusive school environments:

Title IX

Title IX protects students from discrimination based on sex. Its official language reads, “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

It is important to note that this language protects trans* students, as a US Department of Education memo explicitly states, “all students, including transgender students and students who do not conform to sex stereotypes, are protected from sex-based discrimination under Title IX. Under Title IX, a recipient generally must treat transgender students consistent with their gender identity in all aspects of the planning, implementation, enrollment, operation, and evaluation of single-sex classes.

Sexual Orientation

There are currently no laws or policies that explicitly prohibit harassment and victimization based on sexual orientation. Several states have model policies, such as Massachusetts’s.

Pending Legislation

Several federal policies that would protect students, such as the Student Non-Discrimination Act and the Safe Schools Improvement Act, are currently pending. Please see GLSEN’s collection of “Policies that Matter” for more information.
